Policy

By Ordering Work, Dropping-off, Shipping or Transferring any tools or instruments to me, in any manner, for any services you are stating that you are 18 years of age or a person of majority at the place you reside or operate and that you are the owner or legal agent for the transfer of the tools, instruments or shipment and that you understand and agree, consent and stipulate to the stated policies, terms and conditions set forth.

I, Stephen A. Birgells, will deny sharpening services whenever I determine it is in my best interest to do so. Also, when a Work Order contains illegal weapons or tools or is received from a country from which trade is band by U.S Law. Any and all illegal weapons, tools or contraband will be reported to and turned over to appropriate authorities.

All tools I sharpen must only be handled by competent adults and never be accessible to infants, toddlers, young children or anyone or animal that cannot or does not understand the seriousness of being exposed to or the handling of sharp tools and instruments. Due to the inherent risk of injury in using sharp edged cutting tools and instruments you agree to not hold me responsible or liable in any way or manner for any injury to yourself or others resulting from the handling and/or use of tools sharpened and/or serviced by me. You agree that once your tools have been returned to you sole responsibility for the use and care of the tools or instruments by yourself and/or others is upon you. You and you alone must take adequate safety measures to prevent injury from the use of tools I have sharpened and/or serviced.  You agree that I, Stephen A. Birgells, my heirs and estate, shall not be liable for Direct, Indirect, Consequential or Special Damages whether a claim is based on Contract, Tort, Warranty or Otherwise. In no event will the Liability of Stephen A. Birgells, my heirs and estate exceed any Invoice or Work Order charges for any reason. By transferring any tool or instrument to me by any means for service you agree, consent and stipulate to this stated policy along with all terms and conditions set forth and you take full responsibility for the access to, the use, care and operation of those tools and/or instruments.

Liability of Service: I take pride in my work and supply a 100% Satisfaction Guarantee on any particular tool upon my inspection to verify it has not been damaged through use within (7) Seven Days of a client's receipt of their work order. In the event there is a Quality of Service problem a client must bring it to my attention within (7) Seven Days upon receipt of their returned Work Order. If a client is dissatisfied with the sharpening of a particular tool or tools I have serviced within (7) Seven Days of the return of said tool(s), upon inspection of said tool(s) I will resharpen said tool(s) or refund the sharpening charge per tool at my discretion. I will do that which is within my ability to correct client dissatisfaction within the terms of stated policy. It is imperative that all tools be checked for cutting quality satisfaction and brought to my attention within this (7) Seven Day time limit if there is a problem for enforcement of any guarantee. I shall not be liable for Direct, Indirect, Consequential or Special Damages whether a claim is based on Contract, Tort, Warranty or Otherwise. In no event will the Liability of Stephen A. Birgells exceed any Invoice or Work Order charges. In the event there is a Quality of Service problem where such tool or tools are returned to me for corrective service, according to this Policy, those tools and only those tools must be shipped separately and not combined with any other Work Order(s). No other tools other than those specified for corrective services can be included in any corrective service shipment. All individual Work Orders whether corrective or normal must be shipped separately. By transferring any tool or instrument to me for service you agree, consent and stipulate to this stated policy along with all terms and conditions set forth.

Email Policy: Any and all email addresses will be kept in strictest confidence and never shared or sold to a third party by either Stephen A. Birgells or any client requesting information or submitting a Work Order. By communicating with me by any means for service you agree, consent and stipulate to this stated policy along with all terms and conditions set forth.

Pickup & Return Service:  Is Dependent On Work Order Amount & Travel Distance. During heavy Work Order periods no Pickup & Return Service will be available as it would take me away from my duty to attend to present Work Order conditions  Simply put, any and all Pickup Work Orders must be profitable.  Additional Service Charges Will Apply.

It is my policy to provide a high level of service to my clients in meeting their sharpening requirements in a timely manner. Due to the popularity of my services and work order volume clients should always call for service availability to be certain any schedule requirements you may have can be met before delivering or sending any tools or instruments for service. Also, there are times I am away servicing regional or national Commercial Client Agreements and will not be available to receive Drop-Off or Mail-In Work Orders. Be certain to check before shipping tools in order to meet your schedule. All Custom Sharpening Services are performed on a "first come - first served" basis.  All Work Orders are return shipped or notified for client pickup upon completion. If you require a deadline be certain to ascertain it can be met. I will not be held responsible for missed deadlines unless I have committed to such a requirement, in writing, prior to or at the time of accepting your work order. By transferring any tool or instrument to me by any means for service you agree, consent and stipulate to this stated policy along with all terms and conditions set forth.

Work Order Cancellation:  No Work Order can be cancelled, without liability to the client, unless notice of change or cancellation is made and accepted by Stephen A. Birgells before work is commenced and in progress. Cancelled Work Orders, where work is in progress or has been completed will be charged to the extent of the work completed. By transferring any tool or instrument to me by any means for service you agree, consent and stipulate to this stated policy along with all terms and conditions set forth.

High-End Knives, Scissors & Shears: When you send knives, scissors and shears for sharpening you and you alone take responsibility for maintaining any manufacturer's warranty or guarantee. Some high-end manufacturers place specifications on how tools they make may be maintained to enforce their guarantee or warranty. By sending such tools to me for sharpening with or without verifying from the manufacturer any guarantee or warranty restrictions you agree to accept all responsibility and in no way hold me responsible for any loss of warranty and/or guarantee. I do not accept ceramic knives for sharpening under any conditions.  By transferring any tool or instrument to me by any means for service you agree, consent and stipulate to this stated policy along with all terms and conditions set forth.

Check Policy:  Any checks returned for insufficient funds will be charged an additional $75.00 and/or prosecuted to the full extent of the law.

Policy Regarding Drop-off Work Orders:  All Drop-off Sharpening Work Orders must be Paid-In-Full and Picked-up within Fifteen (15) Days of the Work Order. Tools not Claimed and Paid-in-Full for Services Rendered within Fifteen (15) Days of the Work Order will be considered abandoned and will be sold for Services Rendered and/or storage. By transferring any tool or instrument to me by any means for service you agree, consent and stipulate to this stated policy along with all terms and conditions set forth.


Policy Regarding Mail-in Work Orders:
  There may be times I am away servicing regional or national Commercial Client Agreements and will not be available to receive Mail-In Work Orders. Be certain to check before shipping tools to verify service availability to meet your schedule. If I am away your Work Order could possibly sit in the Post Office for weeks or if it is delivered to my door via a common carrier it could sit in the open subject to theft or damage. Always call for service availability before shipping any Work Order. By transferring any tool or instrument to me by any means for service you agree, consent and stipulate to this stated policy along with all terms and conditions set forth.

I Will Take No Responsibility Nor Be Liable For Damage Resulting From Improperly Packed Tools. Your tools and instruments are expensive, take the necessary precautions to protect them in shipping. By transferring any tool or instrument to me by any means for service you agree, consent and stipulate to this stated policy along with all terms and conditions set forth.

List any and all existing damage to your tools on the proper Work Order Form pertaining to your particular tools or instruments. If desired, purchase shipping insurance so that in the event of loss or damage to your tools during shipping you have a claim toward the limits of the insurance. Upon receipt of your shipment I will examine the tools as listed on the particular Work Order Form. If the shipping container is received in good condition and no damage has been listed on the Work Order Form yet damage does exist I will notify you and I will not be held responsible for such damage in any way. Should I receive damaged tools you will be notified and you must file any claim for damages with your carrier.

No Mail-In Work Order Will Be Serviced Or Returned Until Paid-In-Full Unless By Special Prior Agreement Or Terms Of Invoice. Send no cash, checks or credit card information. You must have an email address to be invoiced through PayPal, by me, after I inspect the Work Order for accuracy and add return shipping & handling charges. Orders shipped without an email address will be held up to Fifteen (15) Days from your shipping or postmark dates until I receive a valid email address for invoicing or for return shipping & handling charges. If no email address for invoicing is forthcoming or I have not received Payment-In-Full through PayPal after the specified Fifteen (15) Days the tools will be considered abandoned and sold for storage and handling. By transferring any tool or instrument to me by any means for service you agree, consent and stipulate to this stated policy along with all terms and conditions set forth.

Properly invoiced and paid Work Orders will be Return Shipped by United States Postal Service. Return Shipping for shipments within the United States will be invoiced at Priority Mail Rates. All Priority Mail shipments automatically come with $50.00 insurance coverage.  If you desire additional insurance coverage notify me on the Work Order and you will be invoiced for it. Uninsured or Under-Insured Return Shipping is done so at your risk and I will not be held responsible for any loss or damages.  Turn Around for Return Shipping (delivered and Postmarked at my 22508 Post Office) will be prompt upon completion of the Work Order. There is no guaranteed Turn Around unless stated in writing. All Work Orders are serviced on a "first come - first served" basis. Should there be any problem with your Work Order you will be promptly notified.

International Work Orders: Return Shipping Rates will be the United States Postal Service designated Priority Mail Rate to the particular country. Be certain to notify me if you desire insurance. International Clients will be personally responsible for any and all Customs Fees and/or Duties required by their home country, if any, to be paid in their country and in their currency by them.
